After Tokichi Masao returned back from America, he became an assistant editor of the Japan Times (English newspaper) established in 1897 only by the Japanese. He had worked only for three months. Since on Novemver 1897 he started for Siam (at present Thailand) at the age of 28, to work as a legal adviser to help to make modern codes like Criminal Law, Civil Law, Criminal Procedure Law and Civil Procedure Law. In 1897 Siam and Japan began to negotiate commerce and navigation treaty. During the course of negotiation, it had been discussed as a main problem whether the Siam government would accept Japanese extraterritoriality in Siam. As a compromise the treaty provided for the eventual surrender of Japanese Consular jurisdiction under the certain conditions. One of them was that Siam should promulgate Criminal and Civil Codes, CiviI and Criminal Procedure Codes and Code of Court. So the Siam government applied to the Japanese government for the services of a Japanese lawyer to come and assist M. Rolin-Jaequemyns (General Adviser to Siam government) in matters relating to legislation. Count Matsukata (Prime Minster), Count Okuma (Minister for Foreign Affairs), and Komura (Vice-Minister for Foreign Affairs) found Masao as a suitable candidate because he was well qualified for English conversation, legal experience and diplomatic ability. At first Masao was appointed to a Secretary of Siam Ministry for Foreign Affairs since the position of legal adviser had already been occupied by another Belgian jurist, R. J. Kirkpatrick. At that time there were many Belgian jurists working as assistant legal advisers. If Masao was appointed a legal adviser, they would made a complain about it. But in a while Masao was appointed assistant general adviser because Rolin and Masao could keep friendly relationship. His work was to translate Japanese books and materials into English and to give advice to draft codes and legal problems under the instruction of general adviser. Masao was appointed a member of the Committee on the Codification of Criminal Laws on January 1898. The other members were H.R. H. Krom Mun Rajburi (Prince Rabi), H.R. H. Krum Luang Bijit, Rolin-Jaequemyns, Phya Precha, Phya Kraisee, M. Kirkpatrick and Corneille Schlesser. Masao made the first draft of Penal Code in cooperation with Schlesser till July 1898. In August the Committee began to examine the draft, but the examination was not be done smoothly. Masao had home leave in Japan for ten weeks under the employment contract. During the leave he married with Mitsuko on November 1898, the daughter of Baron Kuki Ryuichi who was Vice-Minister of Ministry of Education and also Japanese Ambassador in USA. Masao made a speech on legal situation in Siam at Law Faculty of Tokyo Imperial University under the recommendation of Prof. Hozumi Shigenori who came from Ehime prefecture, the same native place with Masao. In 1903 Masao got Doctor of Law from Tokyo Imperial University under the title of “Study on Siamese Ancient Law". Masao had four children, but the eldest son died less than one year old in a ship to Japan. So he lived with his wife, one boy and two daughters in Charoen Krung Road (New Road) at Bangkok, His first salary was 1,000 lbs. , but it increased to 18,000 lbs. after he got Third Class Decoration of White Elephant. He and his family could enjoy high rank life , but they suffered from hot and high humidity weather. Many Belgian jurists had illness caused by Thai climate. For example, Kirkpatrick died in 1900 and Rolin died in Belgium in 1902. Masao was so lucky to live for 16 years in Thailand. But when he resigned, he had a kidney trouble.
