This paper is consisted in six clauses. clause 1- A case of strike in South Korea clause 2- Legal restrictions and prohibitions of strike comparing to Japanese law clause 3- Application of criminal law clause 4-Company relief and police action in strike clause 5- Application of civil law clause 6- Disciplinary punishment of union leaders in strike In first clause, it is suggested that a case of strike in South Korea shows many legal problems with strike. The main causes are from South Korean Constitution and labor law. The right to strike in Constitution menas the effect of civil law and criminal law of strike is legal , but actually such effect is not guaranteed. In second clause, it is suggested that there are many restrictions and prohibitions in South Korean civil , criminal and labor law comparing to Japanese laws. There are many illegal strike cases with or without criminal punishment and civil responsibility. In third clause , it is investigated that applications of criminal law, specially business disturbance penalty ("gyomubogaizai" in Japanese) is always applied in strikes. Generally, the guarantee of the right to strike in Constitution means exception of criminal responsibility , but, in South Korea, it is not guaranteed by State, Constitution Court and general courts. Therefore such legal problems are criticized in many points. In South Korea, business disturbance penalty (Criminal Law, clause 314) has applied in strikes. In 1998, Constitution Court took a decision of constitutionality of such clause, but it was contrary to common sense that forbearance, work-stop, and violation of procedure were not guilty. Besides, there are many problems concerning to the extent of criminal law's application, the conception of the legality of strike, and the conception of business disturbance. In fourth, fifth and sixth clause, those are suggested that company-relief action and police action in strike are illegal. civil responsibility of union and disciplinary punishment of union leaders in strike is not illegal , but such illegal decisions have made in South Korea.
