This paper aims to clarify operational principles of the United Nations Organization Mission in the Democratic Republic of the Congo (MONUC), especially the implication of the reference by its relevant resolutions adopted by the United Nations (UN) Security Council to the terms "Acting under Chapter VII of the United Nations Charter". In Part I, the origin and background of the Congo conflicts in Democratic Republic of the Congo (DRC) and the progress of the Lusaka peace process are described since August 1998, before the responses by the UN to these conflicts are considered. The Congo conflicts are confirmed to have three aspects on the levels of parties and targets: civil war (Kabila Government v. anti-Kabila forces) , ethnic conflict (the Hutu v. the Tuti) , and inter-state war (Uganda, Rwanda, Burundi v. DRC, Angola, Namibia, Zimbabwe). Immediately after these conflicts occurred, most African countries have managed to develop the peace process within the framework of the Organization of African Unity (OAU) or the Southern African Development Community (SADC), which has led to the conclusion of the Lusaka Cease-fire Agreement in July 1999. Interestingly, in this Agreement, the parties call on the UN to dispatch a peacekeeping force with a peace enforcement mandate under Chapter VII of the UN Charter. For its part, the UN has supported the peace process by the African initiatives , but according to his first report, the UN Secretary-General only has considered the dispatch of the UN military liaison personnel, whose mandate is to establish contacts and maintain liaison with the Joint Military Commission (JMC), which has been established in the Lusaka Agreement, and also with all parties to the Agreement and so on. In Section 1 of Part II , the details and the characteristics of MONUC are illustrated. The Security Council resolution 1279, which has officially established MONUC, only permits to deploy military observers, but not authorizes the action under Chapter VII of the UN Charter. It is in the Security Council resolution 1291 that the peacekeeping force has been established and that the action under Chapter VII has been authorized to it. This authorization, however, has been only given for the restricted purposes; to protect United Nations and co-located JMC personnel, facilities , installations and equipment, ensure the security and freedom of movement of its personnel, and protect civilians under imminent threat of physical violence. The point here is that such "restricted. action under Chapter VII" has not been considered inconsistent with peacekeeping activities in the Security Council debates at that time. Whereas the latter resolution provides MONUC with the legal basis for its operation, the attributes of MONUC may evolve out of peacekeeping into peace enforcement as the peace process is developing, since the content of its operation is inseparable from the progress of the peace process. That is why the linkage be-tween the legal nature of MONUC and the progress of the peace process and its results have to be verified in the next Section of Part II.
