ONUCI (Operation des Nations Unies en Cote d'IV oire) has worked since April 2004 in Cote d'1voire, whose conflict has occurred in September 2002. The United Nations Security Council Resolution 1528, which has established ONUCI, refers to “Acting under Chapter VII of the Charter of the United Nations" in its preamble paragraph, and permits ONUCI to use the force beyond its self defense. Thus, ONUCI seems to be ranked as a “robust" peacekeeping, like the other recent peacekeeping operations; United Nations Mission in Sierra Leone (UNAMSIL), Mission des Nations Unies en Republique democratique du Congo (MONUC) and United Nations Mission in Liberia (UNMIL). The main aim of this article is to point out the characteristics of ONUCI, providing some suggestions to clarify the legal nature of those “robust" peacekeeping. ONUCI, on the one hand, has shared two points with other “robust" peacekeeping operations. First, the object of the use of force by ONUCI is essentially limited to the provide the security and freedom of movement of United Nations personnel as well as to protect civilian under imminent threat of physical violence within its capacities and its areas of deployment, Secondly, ONUCI is the successive operation to the regional peacekeeping, particularly Economic Community of West African States (ECOW AS), like UNAMSIL and UNMIL. In this case. ONUCI has succeeded ECOWAS Mission in Cδte d'Ivoire (ECOMICI), whose personnel and mandate have been transferred to ONUCI. On the other hand, there are a few differences between ONUC1 and other “robust" peacekeeping. First, no peace agreements in Cote d'I voire, neither Lina-Marcoussis Agreement, nor Accra II & lll , provide the deployment of UN peacekeeping. Later,as the situations go on, the establishment of the UN peacekeeping has been decided though the consent of all parties concerned. Secondly, ONUCI has deployed in parallel with a foreign force, that is , French forces. This parallel deployment contributes to secure the effective implementation of the peace agreements, but it also might injure the impartiality of these forces, especially due to the complicated feelings of Ivoire nationals towards France, a former suzerain state. In the case of ONUCI, the principle of consent among the parties concerned and the principle of impartiality are maintained, with an amended principle of use of force in self defense. Finally, ONUCI is a multidimensional “robust" peacekeeping, which is deployed, both successive to ECOMICI and parallel with French forces, and is expected to contribute to make and maintain the peace in Cote d'Ivoire.
