Land law reform is one of the typical areas where the international donors have been promoting‘transplantation’of global models despite of growing criticisms that such compelled models will worsen the evils of‘legal pluralism’among local formal and informal legal orders. This article purports to propose solutions for overcoming the problems of‘legal pluralism’based on the lessons obtained from a comparative study of process and outcomes of land law reforms of Japan’s Meiji-modernization period with current reforms going on in Indonesia and Cambodia. As a methodological device for comprehending dynamisms of each holistic legal order, the article introduces a cognitive framework consisting of two axes:(i)the axis of allocation methods(state law/ market law), and(ii)the axis of normative choice(civil law=human development/ commercial law= economic development).The experiences of three countries reveal a similarity in the structure of these two axes. In the market law’s aspect, each country has experienced a similar normative conflict between the formal law regime centering on commercial interests for economic growth and the informal legal orders representing civic rights to live. In the state law’s aspect, an equally serious structure of conflict has been observed in each country between the commercial interests of development state and the static civic order of local communities. Comparative analyses into the interaction among the state, donors and local communities amid the process of legal and judicial development will teach a lesson that a normative balancing achieved incrementally though judicial process will guarantee a better sustainable and peaceful process of socio-political development than a stick to extremely growth-oriented norms of the global model.
