From the late 1960s, international environmental liability treaties have been developed especially in the specific fields i.e. oil pollution and nuclear damage. These treaties include“damage to environment per se”only in the limited extent. This is because of limitations inherent in civil liability regimes. The 2004 EU Environmental Liability Directive(ELD)adopted a new approach called メthe Administrative Approach”, which can overcome this limitation. The Directive has two innovative points: at first, it entirely applies to the damage to environment per se and secondly it specifies that the polluter shall owe a series of obligations to act and an obligation to pay the cost in case he pollutes the environment. The adoption of the administrative approach brought these two features into the Directive(I).The preparatory work of the Directive is examined in the Chapter II. In 2000, the White Paper expected a civil liability directive for a future regime, but the European Commission changed its mind next year and then the administrative approach became the main component of the draft Directive in 2002(II).The main purpose of the civil liability regime is remedying victims(private persons). Filing a lawsuit by such people is the key of the regime. On the other hand, under the administrative approach, the role of private persons is rather limited but administrative entities play an important role in this approach(III).The Chapter IV focuses on the damage to biological diversity. The Directive appears to be part of the EU biodiversity conservation regime and it supplements the Bird and Natural Habitats Directive. At the same time, the Biodiversity Conservation Regime is the foundation of the administrative approach. Without information which was collected and managed under the Bird and Habitats Directive, it is impossible for competent authorities to order appropriate restoration measures to polluters(IV).In order to ensure the effective application of the administrative approach, intervention by the competent authorities in the restoration process and the monitoring of the protected natural resources are necessary. Therefore, this approach cannot easily be imported into international treaties’regimes. There is a need to consider carefully when negotiating this approach in international fora.
