In September 2010, Russia presented “Draft Convention on Ensuring International Energy Security”, which highlights challenges the Energy Charter Treaty (ECT) is facing. Does the Russian proposal contribute to creation of new rules to ensure international energy security, especially, the most contentious issue in the past decade - stable supply of natural gas? The Russian draft has some originality, such as ideas for better policy coordination as well as provisions to protect interests of Gazprom. On investment protection, arbitration and competition, it mostly follows the ECT principles, although changes from the ECT language need careful examination. Russia’s most serious challenge against the ECT is on transit rules. The draft makes it unambiguous that its transit provisions shall apply to a carriage within EU. Since this has been one of the deadlocks in the Russian-EU negotiations on draft Transit Protocol under the ECT, mere unilateral expression of Russia’s position cannot solve the problem. Besides, the Russian draft has no provisions on other critical transit issues, such as how to bridge a mismatch between long-term supply contracts and short-term transit contracts, how to decide fair transit tariffs, or how to negotiate on third party access to pipelines. In foreseeable future, Northeast Asian energy market will be driven by bilateral deals between Russia on the one hand and China, Korea and Japan on the other. Transit issues are not imminent to the region, even if the outcome of the Russian-EU talks on transit rules could affect it in the future. Having in mind large-scale development projects in Russia’s Far East and East Siberia, countries in the region had better start discussions on how to develop optimal energy order, apart from the European context.
