In response to the terrorist attack on 9/11, George W. Bush Administration launched the ‘War on Terrorism’ in Afghanistan and detained Taliban and Al Quaeda members as alleged ‘enemy combatants.’ President decided that these ‘enemy combatants’ be tried in the Military Commission, where the defendants’ rights to fair trial were severely restricted. As terrorist suspects, ‘enemy combatants’ were also subjected to harsh interrogation techniques, some of which clearly constituted torture. Geneva Conventions and other treaties leave no doubt that these treatments should be strictly prohibited. Then, why did the Bush Administration act contrary to these rules? What was the legal reasoning lying behind these actions? Did Congress and American people take any action to prevent the abuse of presidential power? If not, what factors explain their obedient and docile attitude? This article explores these questions within the framework of the ‘Imperial Presidency’, a term first coined by historian Arthur Schlesinger Jr. in the aftermath of Vietnam War. Briefly, president is characterized as ‘imperial’ when he believes that his powers over foreign affairs and war making are ‘inherent,’ so that Congress is barred from curbing any of these powers through legislation. Are there any grounds to believe that George W. Bush was also ‘imperial’? In order to show why this is the case, I examine the legal opinion of the Office of Legal Counsel (OLC), the premier office in the Department of Justice. Under the Bush Administration, OLC issued several important memorandums to make a legal case for the President’s ‘War on Terrorism.’ By looking into the logic of these memorandums, the article identifies serious flaws that can only be explained by the resurgent ideology of the ‘Imperial Presidency.’
