Having won independence from the British monarchy with the aid of numerous pamphlets and newspapers, American ‘founding fathers’ believed that unlimited freedom of discussion was essential to the republican government. Reflecting this ideal, the first amendment of the federal constitution prohibits the Congress from enacting any laws that would ‘abridge the freedom of speech, or of the press.’ After World War II, however, this republican ideal was betrayed by the rise of the ‘imperial presidency’, which claimed president’s ‘inherent power’ over foreign and defense affairs. This ideology, which refuses to recognize people as sovereign in these fields, has been used to deny people’s access to the government information. Building on this idea, presidents have constructed a massive system of state secrecy. However, this bloated system of secrecy is anathema to republicanism. If people are left at the mercy of the chief executive to know what the government is doing, presidential power will be unbound. In fact, taking advantage of ignorance forced upon the people, presidents have often manipulated public opinion, and mobilized the nation for his military adventures abroad. But if this is the case, the question remains why the constitutional checking mechanism has not been working. This article addresses this question in three parts. Part I traces the origin of the state secrecy system and considers why the Congress failed to counteract the presidency. Part II takes up three cases of war to see how presidents have actually deceived people by abusing state secrecy. Part III turns to the judiciary and shows that the press has been suffering from the legacy left by the famous Pentagon Papers case. Finally, the article concludes by suggesting that constant competition between the government and free press be the only way to address the problem.
