Alarmed by the President Nixon’s unilateral use of war powers, the Congress passed the War Powers Resolution(WPR)in 1973, pledging to realize the‘intention of the framers of the United States Constitution.’ Over the last forty years, however, WPR has been largely ‘eviscerated’ by presidents who simply refused to follow its prescribed procedures. Several administration lawyers and conservative politicians have harshly criticized WPR, claiming that it is unwise, dangerous and unconstitutional. But why do they insist that WPR is unconstitutional? What is the constitutional theory lying behind their arguments? This Article explores these questions in three parts. In Part I, the Article traces the initial objection raised against the WPR in 1970s. At this stage, ‘presidentialists’ who objected to WPR tried to legitimize the ‘undeclared war’by appealing to the past government practice. Although this objection is still popular, the Article demonstrates that the theory lying behind these ‘presidentialists’ suffer from serious flaws. In Part II, the Article takes up another challenge to WPR posed by the ‘Unilateral Executive Theory’ initially advanced by Reagan Administration lawyers. This theory has opened up the possibility to make the ‘undeclared war’ constitutional by enlisting the concept of ‘executive power’ found in the European theorists such as John Locke, Montesqueue and Blackstone. As the Article shows, however, the republicanism of American revolution sharply contradicts with these European concepts of‘executive power. Part III, the Article addresses the latest challenge to WPR advanced by John C. Yoo. Based on the work of historian Gordon Wood, Yoo believes that framers of the constitution revered aristocracy and gave the President the same war powers as the British King. However, evidence such as Hamilton’s Federalist No. 69 makes it plain that Yoo’s contention is untenable.
