In this article the approach adopted by the European Court of Human Rights (ECtHR)in order to strike a balance between the right of access to courts and jurisdictional immunity of international organizations (IOs) will be analyzed. As illustrated by the jurisdictional immunity of the UN, IOs generally enjoy far broader immunities before domestic courts of their member states than sovereign states. Besides, IOs rarely make themselves subject to alternative dispute settlement procedures. Thus grant of jurisdictional immunity to IOs by domestic courts of their member states, in most cases, gives rise to the serious tension with the right of access to courts. The purpose of this article is to elucidate how the ECtHR has interpreted and applied the provision on the right of access to court (Article6 (1) of the European Convention on Human Rights) where a respondent states is under an obligation to grant jurisdictional immunity to an IO of which the state is a member. After giving an overview of jurisdictional immunities enjoyed by IOs (partI), the “alternative means” test formulated by the Grand Chamber of the ECtHR in Waite and Kennedy will be examined. The test has been reinterpreted by domestic courts of Contracting Parties in favour of the right of access to courts (partII). In Stichting Mothers of Srebrenica, however, the ECtHR itself appeared to be reluctant to directly apply the test with respect to the UN in the context of peacekeeping operations deployed under the Chapter VII power of the Security Council (part III). The analysis of the ECtHR case law will pave the way for rethinking how to locate jurisdictional immunity of IOs and the right of access to courts, and to understand the normative relationship between them under international law today and tomorrow.
