A number of journalistic and academic accounts suggest that conservative jus-tices on the U.S. Supreme Court and political conservatives have become inclined to embrace free speech with regard to the First Amendment cases in the recent past and cast doubts on the traditionally held view that liberal justices are more pro-free speech than conservative counterparts. However, there has been little empirical research to quantitatively assess the above-mentioned trend in the Supreme Court free speech cases. While legal scholars focus on legal interpretation and doctrine in their case cen-tered research, political scientists’ study of judicial behavior tend to overlook legal and social context of the Court’s rulings. This paper examines how conservative and liberal justices have voted in free speech cases involving judicial review after the World War II and ascertain for each chief justice regime which of the two ideological camps is more supportive of free speech claims and how their stance varies across different types of cases. The study provides a brief overview of the Court’s rulings in major free speech cases and reveals voting patterns of the two camps of the justices by using speech cat-egories defined based on the subject of speech and the capacity of speaker. It shows that while the conservatives as a whole not only support less free speech claims than the liberals but also vote more on the side of government regulation than free speech in the Vinson, Warren, Burger and Rehnquist Courts, their position is reversed in the current Roberts Court. In addition, the attitudinal shift in free speech decisions between the conservatives and liberals on the Roberts Court has been brought about by a bunch of cases concerning government regulation of campaign finance in which the conservative majority declared the statutes unconstitutional and the liberals cast dissenting votes.
