In recent years, land policy reforms and land law reforms are executed in number of African countries. The focus of these reforms is put on the introduction of the property rights system with a land title registration into African countries. Some scholars point out that the traditional communal land systems have been a bottleneck in efficient agricultural production, and therefore those old systems should be reformed, by introducing a new individual property land rights system, for development of African countries. The effects of those reform programs require a careful examination. Should these simple reforms be able to achieve the development goals expected in Africa? The integration of informal rights into the statutory law only leads to a dual law system within a country where the customary law is absorbed into the statutory law. Moreover, the simple formalization of customary law should not be taken as a panacea for other problems in Africa, such as population explosion and expansion of the market economy. The land reform required in Africa is the one which brings secure protection of the land rights of the poor, and promotes the construction of an effective institution with poverty reduction in its scope. The reform should avoid radical privatization of land which merely provides people with mortgages to access financial services. What is expected is the development of an institution which functions as the social safety-net for the poor, which based on the communal land tenure system. Land reforms in African countries are required to hold the above view so that the new customary rights can accommodate actual demands of the poor.
